| Rural migrant workers, whose social position is peasant, are a group with the important features of industrial workers.They are economically connected with the agricultural land, mainly engaged in non-agricultural occupations and live mainly on salaries.Rural migrant workers play an important role in the process of industrialization, urbanization and modernization in our country. They are the key factors in solving the problems facing agriculture, rural areas and farmers and in building a new socialist countryside. They have been contributing substantially to the development of our whole country. Rural migrant workers have become a significant foundation for Chinese Communist Party to hold office and an important power to build socialist harmonious society. Rural migrant workers are a new increasingly growing disadvantaged group, the absence of the guarantee of whose rights and interests has become a main contradiction in the construction of harmonious society at present. To guarantee the various rights and interests of rural migrant workers and give them equal national treatment is a significant measure to build socialist harmonious society and an effective approach to the comprehensive realization of socialist harmonious society.To guarantee the legitimate rights and interests of rural migrant workers helps to advance the coordinated development of both urban and rural areas, promote fairness and justice in the whole society, improve the construction of democracy and the legal system and maintain the stability and harmony of the society.Although rural migrant workers have made great contributions to our country's economic development and modernization, their legitimate rights and interests still suffer infringement because of the deficiency in the aspects of the dual structure of household registration system in urban and rural areas, employment and distribution system, the absence of rural migrant workers'right to say, the imperfect laws to guarantee rights and interests and the weak law enforcement, discrimination in opinion caused by the dual administrating system in urban and rural areas as well as the influence and restriction of such factors as rural migrant workers'quality and inadaptation. There exist myriad problems in the guarantee of rural migrant workers'basic rights and interests, such as the right to work, the right of social security, the democratic and political right, the right of development, the right of spirit and culture, the right of habitation, the freedom to change residence. Hence they become the marginalized groups floating at the bottom of the city.Aiming to address the difficult problem of protecting rural migrant workers'legitimate rights and interests, this thesis puts forward the following strategies: firstly, stick to integrated development in urban and rural areas, promote the reform of systems and system innovation, demolish fundamentally the institutional barriers of rural-urban separation and establish a series of integrated urban-rural systems for the household registration, the employment of work force, the social security, the transfer of land, the education, the election and the shelter as well; secondly, stick to the principle of fairness and justice and really grant equal national treatment to rural migrant workers according to the entitled rights prescribed by the Constitution; thirdly, improve the legal system, rule the country according to law and perform official duties in strict compliance with law; protect and realize rural migrant workers'legitimate rights and interests depending on the compulsary force and constraining power of law; fourthly, change the mind of the whole society, stick to the idea of taking people as a dominant factor and treat rural migrant workers kindly; fifthly, strengthen the training of rural migrant workers to improve their quality and promote the development on their own; sixthly, make great effort to cultivate social organizations for rural migrant workers, actively guide them to extensively participate in such social organizations and mass organizations as labour union, Party organizations, Communist Youth League and women's federations, improve the organizing ability of rural migrant workers and really protect their legitimate rights and interests... |
