Studies On The Harmonious Society From The Perspective Of Protecting The Rights And Interests Of Migrant Workers

Migrant workers provide abundant cheap labors for industrialization. They have made great contributions for our country’s economic and social development and gradually become a force to be reckoned with in China’s economic, political, cultural, social life. As the migrant workers have already become a new social stratum, they have consolidated and expanded the Chinese Communist Party’s ruling foundation and also have played an important role in promoting the coordinated development of urban and rural areas, motivating social harmony and stability. However, such a large number of groups is still living in the edge of the city and enjoying fewer benefits than the urban residents. The lack of their effective guarantee in legitimate rights and interests not only affects the realization of social fairness and justice, but also has become a problem which must be solved in the process of building a harmonious society. With the rapid development of industrialization and urbanization in our country, the difficulties of how to protect migrant workers’ rights and interests are gradually increased. So it is essential to study the migrant workers’rights and interests guarantee.In this paper, we not only took the theory of socialist harmonious society as guidance and refer to the Marx and Engels’view of justice, but also used the literature study and system analysis method in the process of analyzing of the problems of migrant workers’ rights and interests protection. Based on the analysis of the historical reasons and realistic obstacles of the damage of migrant workers’ rights and interests of, we tried to put forward the main ideas and countermeasures of how to solve the problem. Finally, we carried out the following conclusions:First, the migrant workers’ rights and interests safeguard have improved in our country, but there are still some problems existed in their rights protection. These problems are mainly manifested in four aspects:1) The economic rights and interests of migrant workers are violated;2) The political rights of migrant workers is hard to realize;3) The protection of migrant workers’social rights and interests is very weak; 4) It is difficult for the migrant workers to enjoy the cultural rights and interests.Second, through analyzing different factors which influence migrant workers’ rights and interests safeguard, there are several factors accounting for this:1) Urban and rural household registration system, employment system, distribution system are the institutional reason which resulted in the damage of migrant workers’ rights and interests;2) The key factor of the damage of migrant workers’ rights and interests is the lack of relative legal system and government’ regulation;3) The direct reason of the damage of migrant workers’ rights and interests is inequality of labor market, unbalanced supply and demand, the lack of sense of enterprise’s responsibility;4), The reasons which subjective restrict the realization of migrant workers’ rights and interests are the weakly ability of migrant workers’ rights protection and poor rights protection consciousness;4) The important factor of the damage of migrant workers’ rights and interests is social ideas of intolerance and the lack of relevant social organizations.Third, it is very essential that the related subjects which include government, enterprises, society and migrant workers must try their best to establish a comprehensive, coordination of migrant workers’ rights and interests of the security policy system in the process of migrant workers’ rights and interests protection.Based on the above research conclusions, we finally carried out five aspects of countermeasures and suggestions:1) Establishing the rights and interests of migrant workers system;2) Establishing the policy environment of the migrant workers’ rights and interests;3) Building the migrant workers’ rights and interests protection organization;4) Improving the migrant workers’ ability to maintain their own rights and interests;5) Improving public’s awareness of the rights and interests of migrant workers.
