In the three decades of reform and opening up, China has a full range of revolutionary changes. The social structure has profoundly changed, while an unprecedented level of change happens in the rural areas. In this context, this article discusses the political status farmers and political rights of Chinese farmers.The first chapter introduces the contemporary theories of social structure and the transition of the social structure. The first part is the introduction of Western theories of social stratification, including the class theory and the multiple theory of social stratification proposed by Karl Marx and Max Weber. And the functional theory and the conflict theory are also important social structure theories. These theories have a great guiding significance for us to recognize the status of peasant. The second part introduces the transition of contemporary Chinese society and the rural society, and analysis what are the opportunities and challenges in the process of improvement of the the peasant political status in the transition.The second chapter deals with the political status of the peasant our country. I introduce the evolution of the political system of countryside firstly. Then I proposed the content of the political status of farmers mainly include the peasant status as the subject, political rights of the peasant, as well as the position of peasant in the political decision-making. At last, I point out that there are three deficiencies in the political status of the peasant: the inadequately implementation of the status of subject, the difficult to guarantee political rights, the shortage of opportunities in participate the decision-making.The third chapter is the legal considerations on the political status of the peasant in our country. In the part of the legislative protection, I pointed out the defects of legislation, and how to strengthen the legislative protection of the peasant status and political rights. In the administration of law, we need to make efforts to improve the villagers' self-governing system, speed up to establish rural social organizations and achieve the change of government functions. In the part of judicial protection, we need to improve the existing litigation system, and guarantee the right of appeal of the peasant, and set up a system of constitutional litigation.The fourth chapter discusses the social measures to improve the political status of the peasant. To improve the political status of farmers, in addition to legal protection, we also need a full range support of the society, need to set up mechanisms for the expression of diverse interests, effectively regulate and control the social stratum division in China to optimize the social structure that better to the development of the peasant, and set up corresponding mechanisms.
