The Formation And Operation Of The New Situation Of China's Foreign-funded Trade Union Study

Labor relations are the most fundamental social relationships. As an association that defends the interests of labors, trade unions has played an important role in the development of labor relations, on the other hand, new labor relations have new requirements to the establishment and operation of labor unions. Since the reform and opening up, labor relations in china has assumed new features, which have new requirements to the development of trade unions. From the end of 1990's, All China Federation of Trade Unions (ACFTU)carried out a nationwide trade union establishment activities and made good progress, but it encountered great resistance in foreign funded enterprises, especially large multinational enterprises. Even in the established trade unions, it is difficult for trade unions to give full play to their functions. When labor relations are experiencing new changes, it is necessary and urgent to study how to establish trade unions and make them effectively operated.In 2006, with the concerted effort and full cooperation of all parties, the first Wal-Mart trade union came into being in China, and before this, almost all the big multinational companies have refused to establish trade unions in the world. Through the methods of literature study and field research, this paper made comparative analysis through interviews, panel discussions, field observations and documents collection. Based on all the information and in a story-telling way, this paper tried to analyze the new mode and content in process of Wal-Mart trade union's establishment and operation through reviewing the establishment and operation process of the trade unions.This paper is divided into four parts. The introduction talks about the topics and the status quo of related researches and design of this paper. The first part analyzes the background of establishment of trade unions. Strong culture of foreign enterprises, increasing of labor dispute in foreign enterprises and social transformation with the main features of globalization have a great influence on the establishment and operation mode of trade unions.With reviewing the three games in process of establishment of trade unions, the second part summaries the new establishment strategies where traditional mode failed. With two typical cases of operation of Wal-Mart trade union in Shenzhen, the third part reveals the operating characteristics of Wal-Mart trade union under the new pattern of trade unions. Based on reflection and discussion of establishment and operation process of Wal-Mart trade union, the fourth part concludes the new characteristics and the connotation of the entire establishment.This paper holds the points that the establishment and operation of Wal-Mart trade union is a strong intervention for the government to realize its objectives. In accordance with the mechanism, this process makes workers take the front stage of the establishment and operation of trades unions. However, the undue dependence of inferior trade unions to superior unions can't guarantee their well function; accelerating the transformation of trade unions functions to rights-defending and cultivating the power of inferior unions is important prerequisite to ensure their functions.
