Religious Legislation In A Harmonious Society Study

There are many definitions for Religion Legislation. The author defined it as the special processes and activities of national or local legislatures constituting laws or regulations which are related to religion. Religion legislation has nothing to do with the liberty of religious believe on spiritual level but the liberty of religious believe on social level. From Harmonious Society to Harmonious Religion, the law-construction brought the religion affairs into its perspective. This not only accords with one of the important characteristics of harmonious society, democratic and law-based. Also it is one of the important ways to protect and promote the religious freedom of citizens. As the development of religion legislation, religion will play an active role in promoting the harmony in society.Until now, a series of religion laws and regulations have been set up in our country, especially the Regulations on Religions which came into effect from 2005. But there are still some imperfections in the religion legislation, such as the vacancy of national religion law, the low level of the laws, the unclearness of legislation purposes, and the immaturity of legislative technique. The main reasons are that the religion legislation does not earn widespread respect and there are many abuse malpractices in traditional administration mode of religion affairs. Making a fundamental national religion law which concluding distinct purposes, clear conceptions, the equality of right and responsibility, good legislative technique, is the key to solve the problems above.In order to facilitate the legislative process of fundamental religion law, we should make sure the fundamental principles of legislation, execute the principle of separating religion from politics, understand the purpose of legislation, and improve the legislative technique. We also need to make a good conjunction of religion laws and religion policies, make clear the relationship of religion legislation and law enforcement, and give well-ordered good status of a legal entity to religion groups or organizations, then upgrade the Regulation on Religion to "Fundamental law on religion" in a proper time.
