Marx's philosophy of law came into being with the vigorous development of industrial revolution and the heat of European revolutions. Based on the criticism to Kant, Hegel and the Western traditions on the philosophy of right, Marx put forward unprecedented revolutionary new theory, which revealed law came into being on the foundation of social material life, and was related to the public power formed at certain period with the development of the forms of social communication, and which altered completely the former explanations to the essence of law and profoundly revealed the dialectical relations among law, economic foundation and the forms of social communication. Marx restored the realistic relation among law , political state and civil society, explained law in an economic and sociological way, revealed the essence of law through political economic research, remained the historic dimension of his theory on social being, and insisted on the critical and affirmative dialectical understanding to modern legal right. Marx's philosophy of law is of significant contemporary meaning and value of times, since it reflected deeply the inner complicated relations among law, state, economy, and society. Based on the realistic situation of contemporary China, we should understand and establish Marx's philosophy of law with contemporary form with the return to the classics, the dialogue with the classics and the innovation from the classics.The framework of this dissertation is as following:In the introductory chapter, the author clarifies the purpose and significance of this dissertation title, defines the subject investigated, provides an overview of related researches and states the framework of this dissertation. In the second chapter, the historical, academic and theoretical backgrounds are analyzed. The third chapter is developed according to two logic clues: the four developing stages of Marx's theory and the continuously deepening of the content of his philosophy of law. The fourth chapter is about Marx's sublation, development and transcension over the western traditions of philosophy of law. In the fifth chapter, the author tries to hold the spiritual core and to explore the contemporary meaning of Marx's philosophy of law with the review of its forming and developing process. Being based on the realistic situation of contemporary China, this dissertation makes an innovative attempt to understand and establish Marx's philosophy of law with contemporary form and to explore its great contemporary meaning and value of times.
