Research On Marx’s Thought Of Legal Philosophy And Its Contemporary Value

Marx’s legal philosophy thought is in the critical theory of inheriting predecessors’ achievements on the basis of the formation of the revolutionary ideology. Though his theory has not been reflect by a special work. But we can find the logic of Marx’s legal philosophy theory through carding Marx’s work which in different periods. Marx’s theory of legal philosophy has experienced a shift in thinking and the process of gradually mature. Realized the transformation from idealism philosophy method to the method of dialectical materialism and historical materialism philosophy.And Marx’s legal philosophy thought is not only the theory, but also show great value in today’s world.This thesis attempts to take Marx’s representative work each time as a clue and analysis the background of Marx’s theory of legal philosophy. The thesis also comb the formation and developing process of Marx’s thought of legal philosophy from the early time to the maturation period and he article summarize Marx’s thought of legal philosophy for the following three aspects:the law ontology, the law value and the law methodology. Comparing the Marx’s thought of legal philosophy with other theories of legal philosophy we can know the characteristic of the Marx’s thought of legal philosophy. Based on these studies, the thesis delved the contemporary value of the Marx’s thought of legal philosophy.This thesis is divided into five chapters:the introduction part mainly illuminates the writing purpose; significance and the present situation of the research on Marx’s legal philosophy thought, both at home and abroad are briefly introduced in this paper, the main contents, writing method and innovation point. The second chapter is "the Marx’s legal philosophy thoughts". Mainly introduces the political conditions and theoretical sources of Marx’s legal philosophy thought. And then briefly introduces Marx’s legal philosophy thought formed in three stages. The third chapter is "the main content of Marx’s legal philosophy thought. This paper mainly through the "what is philosophy of law", "what is philosophy of law should be" and "how to know law philosophy" three aspects of the main content of Marx’s legal philosophy thought. The forth chapter is "characteristic of the Marx’s thought of legal philosophy". This part is about the characteristic of the Marx’s thought of legal philosophy. The fifth chapter is "the value of the Marx’s thought of legal philosophy". This part analyzed the contemporary value of the Marx’s thought of legal philosophy.
