Research On Family Justice From The Perspective Of Feminism

In the paper of A Study on Family Justice from the Perspective of Feminism, firstly, it starts with analysis of the history of family justice, and expresses the phenomenon that the absence of Justice in Family from the traditional justice theory. In addition, it discusses the reason of the "home-absence" in western traditional philosophy from the aspects of "the decadency of family image in western classics"、"the inverse family doctrine in Theology " and "the alienation of family from slavery system" and so on. It also points out that "home-absence" lead to the lack of gender consciousness in sexes and the dilemma situation between the public and private. Secondly, it elaborates the family justice in classic liberalism that justice is only applicable to the public domain, Engels’view of family justice that only by discarding the capitalist private ownership can achieve women’s liberation. Thirdly, it analyzes the western feminist’s criticism to the mainstream theory of justice, the query to Engel’s theory of the origin of private ownership in oppression of women and the criticism and inheritance of family justice in traditional view of female, and from the angle of the female through the anatomy of two different theories about justice of Rawls and Sandel, the western feminists analyze the reason that Rawls’s fuzzy position of justice in family and have demonstrated the environmental justice in family. At the same time, they against Sandel’s perspective of family and justice to some degree, point out biased errors that Sandel’s view about Rawls’s priority of justice, and argue that justice is the most fundamental and necessary virtue. Then by analyzing the feminist proposed "private political" slogan, it argues that justice must be related to the radical family, summarizes the constructing of Family Justice’s theory basis, and analyzes the relationship between "Just Ethics " and "Care Ethics ". Furthermore, it suggests that we shall put just ethics and care ethics in a creative tension in order to find a way for the construction of the family justice. Finally, it reflects the Western feminist family justice, and elaborates the theoretical meaning of feminist family justice and its realistic significance in contemporary China.
