With the contemporary higher education internationalization becomes the world trend make the maintenance of the educational sovereignty seem increasingly important. This paper is on the basis of existed higher education internationalization theory and state sovereignty theory, exploration educational sovereignty issue and maintenance under the higher education internationalized background, by using the methodologies of literature analysis and comparative research, analyse the influence that the educational sovereignty may appear in higher education internationalization, put forward maintain countermeasure of educational sovereignty under the internationalized background.There are three parts in this dissertation.Part one, The theoretical research with educational sovereignty. In this part, the author have described the concept of the educational sovereignty at first. The educational sovereignty is a part of the state sovereignty, it is the supreme power of dealing with affairs related to educating in this country, shown as the supreme power of conduct its domestic educational affairs inwards, shown as its independence and the initiative right while conduct educational affairs outwards. Secondly , point out that protects the educational sovereignty have very important meaning. The education sovereignty is a state sovereignty component, concern the national security. Protect educational sovereignty is the important prerequisite that country guarantee educational function developing. Protect educational sovereignty can assuring the country's educational reform and opening to the outside world develop forward; Maintain the educational sovereignty, can lead and develop the international competition of higher education correctly. So the author chose educational sovereignty to write the graduate paper.Part two, Analysis of the influence with educational sovereignty for the higher education internationalization. Among this part, the author have done the total introduction to the higher education internationalization at first, from its intension , function to the challenge that it brings. The higher education internationalization is a world trend of contemporary higher education. The higher education internationalization is while bringing opportunity for development to higher education of developing countries, make the higher education of developing countries get into a difficult position too. Concretely, the threat that the educational internationalization brings to developing country is mainly as follows, (l)the recessive political purpose in the higher education internationalization can't still be ignored; (2)Higher education internationalization bring talent and fund outflow that led hidden danger to the economic development; (3)Threat of postcolonial that the higher education internationalization brings. And then, the author has analyses the influence on the educational sovereignty of the higher education internationalization that bring. On this problem, the author have described from two respects: The form of expression that the education sovereignty fights for in the internationalized process of higher education at first. Secondly has analysed the influence and the way on the educational sovereignty of higher education internationalization. After the eighties of the 20th century, the remarkable exhibition of higher education internationalization is the international exchange of higher education move along the road toward educational trade most. Because bring into operation of the higher education internationalization's main course is teacher internationalization, student internationalization, Joint school, launch long-distance information cooperation. The educational service trade of WTO is the higher educationinternationalization in the contemporary important content and form of expression, accession to the WTO make education internationalize go to deep and wide range. WTO has stipulated four ways of service trade: Cross-border supply, Consumption abroad, Movement of Natural Persons, Commercial Presence. These four way contain basic content of higher education of internationalization basically, so the author combination two of them to discuss their influence on educational sovereignty. Particularly, the main influence is: (1)Influence on the educational sovereignty of the educational way internationalization. Include the influence of educational sovereignty on launch long-distance information cooperation and run a school jointly; (2)Students exchange the influence on the educational sovereignty; (3)Influence on the educational sovereignty of teacher's internationalization.Part three, In this part, the author expound the maintenance of educational sovereignty under the education internationalized background in two respect, aspect of idea and aspect of practice. Realize the contemporary development of sovereignty, educational sovereignty correctly at first at the idea aspect. Firstly, from the analysis of the present different theories with sovereignty we can see that economic globalization having already produced the great impact to the national country and state sovereignty, state sovereignty faces the unprecedented challenge. Developed country and developing country have different positions with sovereignty, so we must establish the growing view of state sovereignty, educational sovereignty is among the state sovereignty, their have two kinds of views as to educational sovereignty and relation of state sovereignty: Cut apart view and Entirety view of state sovereignty. From the cut apart view can see that educational sovereignty have layer level, and if we under the principle for share educational sovereignty, it will not jeopardize the national status as independence and the initiative with sovereignty to amortize independently. Secondly, the higher education internationalization is not meaning that totally in line with international standards. Internationalization and localization complement each other. If what the internationalization be emphasized is a kind of response which complies with development made under the background of the economic globalization in higher education, then the education localization ensures higher education to keep thier own characteristic in the internationalized process, led higher education to develop in the healthy and orderly direction. Educational localization is the developing country to favorable riposte the post colonial cultural behind the globalization economy. So long as we deal with educational internationalized relation with localization correctly, appreciate the localization of education, the educational sovereignty will get better protection. Thirdly, correct to appreciate the influence of educational sovereignty on education service trade that China accession to the WTO , First of all , join to WTO is a independent choice of our country; Second, we can safeguard state sovereignty in the regular frame of World Trade Organization . So accession to the WTO participate in educational service trade can't threaten educational sovereignty fundamentally.After acquaint with aspect of idea, the author propose safeguarding advice on practice aspect. 1. According to the need of development at present to revises and perfects the law; 2. Improve ourselves school quality , promote educational competitiveness , maintain the education security; 3. Establish confidence, strengthen the consciousness with educational sovereignty on the thought , strengthen the education in patriotism; 4. Hit out voluntarily, implement the 'Go-Out policy; 5. In educate developed district, set up several " educational special zones ", promote the educational fast development of our country.
