On Personal And Public Interests Of Conflict Resolution

On the base of the improvement of right concept, the relationship between individual interest and public interest has been widely concerned. The conflict between them appears in every area of society, such as the problem of education, revenue, family planning in constitutional field, and the problem of produce just, supervision in procedural field, and the problem of demolition, environment protection, bankruptcy in civil and commercial law field. So it is necessary to research the relationship between individual interest and public interest, to find the reasons of conflicts and to propose the solution.Introduction introduces the"the stubbornest household in Chongqing"and the"Ting Xu case", leads to the theme of this paper.This paper is divided into three chapters.Based on the value of individual interest and public interest, the first chapter introduces the definition and history of individualism and socialism, and analyzes the relationship between individual interest and public interest.The second chapter focused on the reasons of the conflicts between individual interest and public interest. By analyzing the performances of conflict in various areas, lead to the four reasons: the lack of legal provisions, the abuse of the"public interest", the lack of judicial system and the impact of traditional beliefs.The third chapter discusses the harmony of individual interest and public interest. It contents four aspects: clarify the legal definition, humanize the right concepts, restrict the government functions and balance the mechanism of interests.Concluding remark sums up the whole.
