The Wenzhou Collective Land Acquisition Approach Reform

In the recent flourishing urbanization of china, the new increased urban land has been expropriated from collective land. Due to the current unreasonableness land expropriation system, a number of shortness of the existing rural collective land expropriation system has been exposed in the process of urbanization, on a background of economic system of china switching to market economy. The most concerned problem is the insufficient compensation for the land expropriation. Wenzhou government has increased an extra returnland(留地)compensation in addition to " The Law of Land Management', which has greatly increased the practical value of the land expropriation. In this research, we discuss about the methods used in Wenzhou's collective land expropriation especially the problems which have been caused by the returnland system(留地制度)when it increasing the compensation for the land expropriation. According to different part, different methods have been used i.e. quantitative or qualitative analysis, or combination research skill and the associating theory and practical research skill. The research shows that even though the returnland compensation (留地补偿) has solved the problem of the insufficient compensation properly, it has brought about some side effects such as low efficiency of land expropriation , unfairness of compensation for the land expropriation and disadvantage to urban planning. By analyzing the shortness of Collective land expropriation methods in Wenzhou, the research approves that China need to absorb the experience of wenzhou's when bringing forward the reformation of land expropriation system, and China must abandon the way of the returnland compensation( 留地补偿) when trying to increase the compensation for the land expropriation. Additionally, the research proposed the suggestions aiming at the rigidity of the land expropriation standards, causality of practical process and unreasonableness of distribution system of the compensation for the land expropriation. The suggestions include establishing confirmation mechanism of a flexible standard of the compensation for the land expropriation, the clarity of land property right, and the clearly defined compensation distribution of the land expropriation.
