Study On The Problems And Countermeasures Of Collective Land Expropriation And Housing Demolition

The collective land acquisition and demolition of the building is an important way to accelerate the process of the new urbanization construction,improve the efficiency of land intensive utilization,which is also the main factor leading to social conflicts.How to solve the problems in collective land house acquisition demolition has become a theoretical and practical problems to be solved.Taking Changsha Yuelu district as an example,this paper studies the current situation,problems and causes of the collective land expropriation and demolition in Yuelu district through the case research method and social statistics method,and finds the following research conclusions:The problems in the process of the demolition of collective land in Yuelu district mainly represent four aspects.Firstly,the compensation system is imperfect,which is low compensation standard,narrow compensation scope,single compensation form,unreasonable compensation calculation,and unfair compensation distribution.Secondly,the removal procedures are not complete,that is,imperfect hearings and public participation program,lack judicial relief,too much and too early of the policy of land artificial restrictive;Thirdly,the demolition measures of the government and developers are not standardized,easily leading to violent demolition.Fourthly,the behavior of the person that is evicted is badly,that is,poor financial ability,"disorderly take false" speculation phenomenon etc.The reason of these problems in collective land housing demolition is various.The main reasons are the following factors: the absence of government function,the public interest is not clear,the fight of the demolished,and supervision mechanism is not perfect.In view of the problems of the collective land expropriation and demolition in Yuelu district,this paper puts forward relevant policy suggestions from six aspects,such as strengthening the legislation of demolition and relocation,improving the procedures of demolition and relocation,standardizing the means of demolition,improving the compensation scheme,constructing the supervision mechanism,and changing the ideas.
