Nowadays, the soil contamination is severe, deeply influencing the economical development and the survival of human being in our state. Therefore, it is imperative to strengthen soil-contamination prevention and legislation. This paper firstly defines the concept of soil contamination, analyzing the main types of soil contamination in our state; then introduces the status of prevention and legislation of soil contamination in America, Japan and Germany, assessing the advantages of each; after that, the paper commentates the present soil-contamination prevention laws and regulations in our state systematically, pointing out the advantages and disadvantages; finally, the author considers that the soil-contamination prevention and legislation shall be handled macroscopically from three aspects, namely basic principle, legislation mode and law mode of soil-contamination administration, and microscopically, through formulating special soil-contamination prevention laws and setting up scientific administration system and reasonable institution of law, and at the same time, the supporting laws and regulations of soil-contamination prevention shall be improved, building the effective law system for soil contamination in our state. |
