Water Pollution Control Field Of Law Enforcement Issues Empirical Research

From the 1970's, our country has put forward the policy for environmental pollution that"prevention should be combined with the control, among which the prevention should be the primary task ". Warning that we should not follow the old way of the capitalist countries has been put forward repeatedly. But the past 30 more years didn't witness the effective prevention and control towards water pollution development by us. In recent years, the water environmental problems are becoming more and more serious under the double pressures from the tight relationship between the water supply and demand and the water pollution.The law of the People's Republic of China on the Prevention and Control of Water Pollution is an overall comprehensive law in the inland China. It prevents the water quality of nation's main river basins from deteriorating rapidly in a certain extent. However, because of the lack of workable measurements towards the control of water pollution, it hasn't achieved the purpose of legislation since the implementation. There are still some problems worth considering. Such as "the abnormal use of water pollution treatment facilities", "the excess emissions" and "private establishment of the dark tube". The boundary of which is not clear, law applicable difficulties; etc.This paper proceeds from the main problems which are encountered by the basic environmental protection departments, and then analyze the difficulties in the law enforcement on the basis of introducing the relevant laws, regulations and judicial interpretations. Meanwhile, the writer will put forward the corresponding suggestions according to his first-hand law enforcement experience, in view of the problems existing in different law enforcement. The full text is divided into four parts.Part I: Introduce the pollution situation of water resources, water pollution prevention and legislation and the main problems existing in the environmental law enforcement. Part II: Analyze the difference between "the abnormal use " and "excess emissions", and put forward some suggestions on how to perfect the relevant terms.Part III: Analyze the existing problems in the implementation of "should pay amount of blowdown ", and put forward suggestions on how to properly understand and perform it. Part IV: Analyze the content of "private establishment of dark tube" and put forward the proposal on how to deal with the private establishment of dark tube and the behavior of the excess emissions.
