Ecological Forest Benefit Compensation System Legal Preliminary

Forest has both significant economic value and ecological value. Compensation system of public forest ecological benefit is an important way to achieve ecological value of forest. Nowadays, the Western countries and some advanced developing countries had gained considerable and mature experience in it, but the researches of it in our country started late. Although the existing Policies and regulations had played a certain role on the protection of forest ecological environment, but current compensation system of public forest ecological benefit had plenty of shortcomings such as low compensation standards, unclear compensation objects, single compensation type, lacking of protection of compensation procedures and so on, resulting in the compensation system ran poorly.This study had firstly introduced the characters and structure of compensation system of public forest ecological benefit in our country and the necessity of established the legal system for it, on the base of the analysis of its concept. Secondly, it had further discussed the environmental rights, equity theory and other legal theories embodying by compensation system of public forest ecological benefit, due to the introduction of current related legal and policy environment in China. Thirdly, it had carried out detailed analysis of the shortcomings in legislation and supervision of current compensation system of public forest ecological benefit in China, by comparing the legislation and practice on it in other countries. Finally, it was for the purpose of providing some favorable references on compensation system of public forest ecological benefit ofChina as above points on it.
