With the development of genetic technology, foreign and China have emerged in thephenomenon of genetic discrimination in employment. Genetic discrimination in employmentviolates the equal employment rights of workers. Some countries have developed special legalregulation, however, China's legislation in this regard is the blank. on the basis of the UnitedStates and Australia's anti-employment genetic discrimination bill, this paper puts forward theproposal to build the legal system of China's anti-employment genetic discrimination. Thisarticle is divided into four parts:The first part is an overview of genetic discrimination in employment. This sectionintroduces the concept of "genes", the development of genetic research, the generation,status,reason and harm of genetic discrimination in employment.The second part, through the summary of contents of America's 《The GeneticInformation Nondiscrimination Act of2008》 and Australia's 《Genetic Privacy andNon-discrimination Bill1998》,this paper puts forward the contents China can learn fromthem.The third part analyzes the current legislative situation of China from three parts: thestatus of legislation of genetic discrimination in the employment, the status of legislation ofthe confidentiality of genetic information, lack of specialized study of genetic discriminationin employment agencies.The fourth part presents the legal system idea of our country against geneticdiscrimination in employment.The main contents: Legislative principles, the terms defined inthe legislation applicable to the scope of employment, the identification of geneticdiscrimination behavior, the rule of confidentiality of genetic information, the establishmentof specialized agencies.
