On Legal Protection For Rural Immigrants' Right And Interest In Later Stage Support Of Three Gorges Reservoir Area

As a well-known century project, the success of Three Gorges Project doesn't depend on the project only, but more depends on the goal which intends to make the 1.1 million migrants move out, relocate well and grow rich gradually. In order to realize the goal, we must establish legal security system for them now due to the development-oriented migration policy and the requirement of relocating migrants according to law. Those rural migrants are influenced a lot by the Project, they face more difficulties when they rebuild home or appeal for help. Therefore, they need more attention as disadvantaged group. We should especially establish a legal security system to ensure and protect their rights.Focusing on the problem, the writer conducts a systematic and exploratory study on establishment of legal security system for migrants in rural area in later stage support of Three Gorges Project, based on relocation's present situation and experience of migrant's rights protection home and abroad. It mainly includes three parts as the followings:Part1:The basic problem existing in the later stage support for Three Gorges Project's migrants in rural area. It begins with the definitions of Three Gorges reservoir area, migrants of Three Gorges reservoir area, countryside migrants and rural migrants'rights in late-stage support of Three Gorges reservoir, and further more, makes it clear about the basis of rural migrants'rights protection——the rights to live, develop, know, participate and supervise. Then, from both microcosmic and macroscopic perspectives, the writer elaborates the theoretic basis of the rural migrants'rights protection——human rights, civilian rights, development and stability of the society. At last, the writer points out the supposed state for the rural immigrants'rights which includes the insurance of rural migrants'subject status, all-round rights protection, focusing on rights to live, develop, know, participate and supervise as well as efficient decision-making participation, rights expression, coordination and subsidization system.Part2:Present situation of rural migrants'rights protection of the Three Gorges Project. Combined with empirical investigation, the writer investigates the manifestation of rural migrants'rights and interest damage, including the damage existed and caused in the later stage support. Then, based on the rights to live, develop, know, participate and supervise, the writer analyzes the policy and law about rural migrants'rights protection and finds out its defects.Part3:The establishment of the legal security system for the Three Gorges Project rural migrants'rights protection in the later stage support. Using documentary and comparative analysis methods, according to the past experience both at home and abroad, the writer proposes the basic ideas and key systems for the Three Gorges Project rural migrants'rights protection in the later stage support. For the establishment of the basic ideas, the writer points out two main principles from the perceptive of economic law——society standard and restrictive government. And the basic ideas also include the later stage support by law and the combination of indemnification and development. For establishment of the main systems, the writer suggests that we should emphasize establishing the following kinds of systems——systems of capital input and management on the later stage support, social security, training and employment promotion, project support, participation, surveillance as well as subsidization and law support for the rural migrants from the Three Gorges Project area.
