The Public Participation Of Legislation

Legislation should reflect the will of the people, is fundamentally by our socialist country's system of nature. This requires we must implement the principle of democracy, realize legislation democratization, safeguard the people's through various channels to participate in the legislative activities to fully centralized intelligence and reflect public sentiment public opinion. Along with the socialist democratic and legal construction of development, we should gradually make the masses to participate in the legislative activities of ways and form institutionalization, procedure and scientificalness, this also is the inevitable requirement of democratic legislation. Based on the review on legislation in our country, based on the exploration of the road of legislative participation theory, we try to demonstrate the public's legislative participation mechanism and seek to build our public legislative participation mechanism of feasibility. Through the analysis of the legislation of public participation and practice dilemmas, we try to know the problems in constructing public participation in our country legislation system in order of being helpful in constructing China's legislative participation mechanism of public assistance. Specifically, it includes five parts.The first part expounds the basic theory of public participation in the legislation. Based on what is legislation, what is the public participation, it leads the meaning of public participation in legislation, analyzes the theoretical basis and function of the public participation in legislation and simplely introduces the form of public participation in legislation.The second part we try to know the advantages and disadvantages of legislative public, legislative hearing system by analyzing the American, Japanese public to participate in the legislative process practice , in order to help us to establish and perfect our public participation in the legislative system. The third part is mainly the reviews of the public participation in China , namely 1949 to 1956, the late 1970s to the early 1990s, the early 1990s to the 1990s and now. We should realize that with the development of China's socialist democracy and legal system construction , the process of legislation public participation has been strengthen and deepen. It also includes the analyse of the current public participation in our country legislation. We point out the problems in legislative public and legislative hearing system and analyze the reason why they exist.The fourth part is about the perfecting of public participation in our country legislation , such as cultivating the public participation awareness , improving the system of people's congresses, perfecting the legislation, perfecting the legislation public hearings, establishing interest group endorsements and legislative assistant system etc , in order to provide useful support and help to perfect the relevant systems.
