Study On The "Legislation Protect Of Laborer's Occupational Health"

The problem concerns occupational health was produced with the labor production,and was developed along with the production of productive labor."Labor creates the world",in order to survive and develop forward, humanity creates the material and spiritual wealth through production process for meeting all kinds of needs from society.There are various hazard factors which effect laborer 's health and safety. On the other hand, the laborer are not fully capable of resisting these hazards. Concerning this condition, if there is no any measure for controlling these potential hazards, casualty accidents or occupational disease may occur at any time, which will threats safety and health of the laborer. Therefore we must take effective measures to eliminate or control these hazard factors to ensure laborer's safety and health no matter in the past, at present or in the future.The subject of this paper is laborer 's occupational health, this paper introduces the science content of this subject, analyzes the protection deficiency in this area . With reference of advanced experience from foreign countries, this paper aims to improve legislation style this subject. This paper is about 30,000 words, and is divided into four parts.The first part is overview of employee occupational health. This section introduces meaning of laborer's occupational health, and the significance and function of protecting laborers' occupational health, then deduces the urgency and importance of protection in this area.The second part introduces protection condition of occupational health in foreign countries such as USA,Japan,UK and Canada and so on. Based on analysing relating law system, summarizes advanced experience in legislation,enforcement and institutional of these industrial countries.The third part introduces protection situation of employee occupational health in China. In combination with the current relevant laws and regulations,introduces the protection condition of occupational health for Chinese people , and point the improvement in our society,including lack of unified legal documents, law enforcement is insufficient, social concern is not enough, psychological health protection do not put on the agenda.The forth part is suggestion of perfecting employee occupational health in China. At first, formulate a comprehensive law which is strong enough for protection laborers. Thorough provision of this law, enhance enforcement, and emphasize laborer's rights and psychological protection by law .
