Student Village Officials System (SVOS)has been carried out about twenty years and there are more and more Student Village Officials(SVOs), but on the base of the operation of all over China the prospective functions have not come true and the ability which to serve for the construction of the rural area of the"official"is expected to be discovered. The five-year-project of electing village officials which was directed by State Council has been ran three years, in the period of beginning of the twelfth five-year-plan the construction of the country is booming and the new type rural cooperative has grown up all over the country, the questions about the SVOS come one after another. Such as,The state of SVOs is still not established definitely, the election of SVOs can not to meet the request of the country, the jobs are not make the valuation of the SVOs to come true, the personal benefit can not be guaranteed, the development of SVOs is at sea and so on. Moreover the election, the collocation of rights and obligations and so on of agents of primary self-governing organization have knotty problems. All these problems have resulted in the block which obstacles the development of SVOS and SVOs, on the one hand that the SVOS has varied, and the other hand the University students found the SVO was very difficult to do as. So, these troubles entangled the University students who are seeking jobs and also confused the primary self-governing organization which were seeking for development.The SVOS was a Chinese type mechanism which was from the process of modernization especially the rural modernization and the construction of the new countryside, and it has the function to push the development of the county and can diminish the loan of University student who are seeking jobs. However, the threshold of the mechanism, there are many flaw to be conquered. And the whole society is care about the problem,on the base of theory of foreign nations, many scholar in some area studied the phenomena and put out some counter plans from different views. From these researched fruits, the paper tries to discuss and study the SVOS and SVOs at the point of jurisprudence.The legalization of SVOS is the key to certified the statue of SVOs and ensure the benefits of them, and is also to ensure the SVOS effectual implement and effectively push the rural construction. Only through the serious filter of the ways of legalization , the aim of legalization will be come true. Through explaining or amending Organic Law of Villagers Committees, making some definite policies legalized and have the coercive power and by the way of reform of household registration system to achieve the equality and fair between residents in the city and the country, one aspect is strengthen the management about the SVOs, the other aspect is reinforce the sense of consciousness of freedom. In these ways the expectation which the rural or peasants'organizations can stand on their own feet and be fused with city, and the equality between SVOs and peasants can be formed gradually and promote to grow up each other. By these methods to solve the problem of SVOs and boost the construction of the new socialist countryside and structure a socialism harmonious society.
