On The Improvement Of Laws And Regulations Of Public Buildings' Energy Efficiency

As China's economy is transforming from the planned economy to the market economy, the environmental issues are becoming more important. In order to deal with the typical environment and resources problems in various fields, China began to set some related laws and regulations focusing on the public buildings' energy efficiency. Until the public institution regulations enacted, it promulgated the construction of the legal systems in this area into a new phase.According to the records in Ci Hai, the public buildings are defined as unproductive buildings which are utilized in social practices. Generally speaking, the buildings can be divided into the productive buildings (or the industrial buildings) and the non-productive buildings (or the civil buildings). Among them, the civil buildings can also be divided into the residential buildings and the public buildings. The public buildings includes the industrial projects which has the function of the civil buildings, mainly including the state office buildings and the commercial, the services, the education, the health and other public buildings. Public buildings' energy-saving refers to a behavior patterns which could induce, motivate or force people to degrade the buildings' energy consumption through understanding of the public buildings' energy efficiency body's rights, obligations and the powers of other related bodies.The legislations in public buildings' energy-saving in China went through three stages including the beginning period, the upgrading period and the breakthrough period, which initially established a public buildings' energy conservation planning system, the standard system, the incentive system and the energy-saving supervision and management system. However, China's current legislations in public buildings' energy-saving has many problems, such as the legislation ideas behind the social development, the disunion aims of the related legislations, the existing problems of standard system such as the weakness in structure.In order to construct the legal system of public buildings' energy efficiency, it is necessary to select the right theoretical basis. Some theory should be the fundamental principles of these legal systems. For example, the overcoming of failures, the social basic interest, the social justice and the social responsibility. Under the guidance of these theories, we should make a breakthrough in these legal systems including the market entity admittance, the energy-saving charges, the economic incentive, and the energy saving system in supervision.
