The author first introduced the foreign definition and our definition for the concept of Community Corrections, and then describes the characteristics of Community Corrections. Then the author analyzed the role of Procuratorate and the other function section in Community Corrections. And then discussed the theoretical foundation and legal basis of the Supervision, gave the thought of the socialized execution of punishments. The last one is the brief introduction to the way and the main content of the Procuratorial SupervisionChapter two introduced the current status of national and regional legislation on the Supervision for Community Corrections, including the United States, the United Kingdom and Australia and so on. Also, the author has introduced the overseas relevant laws and regulations.Chapter three mainly analyzed the Problem existing in the Community's Corrections of the Procuratorial Supervision in our country. The author first introduced the current status of the supervision, then analyzed problems and what caused the problem existing.Chapter four discussed and studied how to improve the Procuratorial Supervision for Community Corrections and the significance of improvement. Borrowing from abroad legislative with Chinese situation, the author proposed four proposals:updating the penalty executive principle, drafting the uniform criminal executive law, establishing executive body, enhancing supervision means, empowering the right of correcting the illegal to the procuratorate, and establishing the relevant Accountability mechanisms, extending the areas of legal supervision. |
