Study On Administrative Accountability Of Public Access To The Government Information

With the process of transparent, responsible, legal government construction, the public's legal consciousness and the public's awareness of the right to know are being broadened, and there has been process for the public access to government information; Due to the lack of relevant supervision and evaluation measures, the government behavior cannot be supervised and restrained, leading to the ineffective result of public access to the government information. So the supervision and accountability mechanism with scientific, reasonable and effective will need to be set up in order to supervise effectively the operation of the power to gain government information, ensure it meet the public maximization demands for the government information and promote the public trust for the government.The previous researches at home and abroad on administrative accountability are mainly about accountability elements, the concept, and theoretical basis, perfect path and so on from the perspective of politics, public administration and law. In this paper it is argued that the administration accountability should be carried through the process of public access to government information throughout as a supervision system and responsibility system. The establishment of transparent government, improvement of the administration ability and credibility and achievement of the public right to know all the information require to implement and strengthen the government's administrative accountability. And modern document management theory and doctrine of popular sovereignty are the theoretical basics for administrative accountability of the public access to government information. At the same time, the current legal system, the rich practical experience and the supports of broad public make the administrative accountability of public access to government information possible. There are many problems in process of its implementation such as lack of accountability consciousness, missing accountability organizations, single subject, and backward legislation and so on. Based on the analysis of the obstacles and reasons it is concludes that a design scheme is presented from these four aspects of accountability consciousness, accountability legal system, accountability subject and accountability supporting operation mechanism with such the principles as responsibilities consistent, equality, transparent, relief and lawful accountability and so on to perfect the administration accountability of public access to the government information.
