Facing disasters, no meter natural or artificial, human beings'basic instinct is to escape. After the World War II peace and development become the key point of the society. Meanwhile, new social problems emerge with the economic globalization and integration, just like climatic changes, environmental pollutions, the exhaustion of natural resource and the high-risk and frequent accidents. All these disasters make a great deal of people leave their original home, actively or passively, which can be named as Ecological Refugees.Not only have the Ecological Refugees created deficient attentions of the international society, but also they get insufficient rescues and protections. Because there is no protection about ecology in international jus cogens, global ecological environment undergoes daily deterioration; the number of Ecological Refugees experience daily increase; the legal position of Ecological Refugees which is not ratified by International Refugees Law is not clearly identified; Ecological Refugees can not get the due relief as other refugees; there also lacks international mechanisms to help the Ecological Refugees.Based on the current system, the system on the relief and protection of the Ecological Refugees builds to generally analysis the current protective ways, use other relative systems for reference, and make efforts to put forward a comprehensive, detailed and feasible protective measures.
