Studies Of Disaster Emergency Legal System

On May 12th 2008, the occurrence of "Wenchuan Earthquake", was a severe test for our country's disaster emergency legal system. It has proven that China's response to disaster is very fast, and China's construction of disaster emergency system is quite effective, which has played a major role in the earthquake relief. However, after the earthquake, it can be clearly seen that there are some problems and shortcomings on the disaster emergency management. To bring the power of the laws in better play into the disaster emergency management, and to examine and remedy the shortcomings have become extremely serious problems urgently to be solved in the construction of China's disaster emergency legal system.This paper consists of three parts:the introduction, the main body, the conclusion. In the first part, the writer gives a brief introduction on the disaster emergency legal system. There are four chapters in the second part, from chapter two to chapter five. In chapter two, the writer discusses the basic theory of disaster emergency legal system, such as its concepts, the essential composition, the basic functions of the principles and the features. In the third chapter, the writer studies the development of China's disaster emergency legislation, and explores the achievements and shortcomings in our disaster emergency system according to the "Wenchuan Earthquake". In the forth chapter of the article, the writer investigates the main characteristics of foreign countries'disaster emergency legal systems and gets the inspiration from the research. In chapter five, based on the reality of our country, the writer puts forward proposals to improve the China's disaster emergency legal system. Finally, the writer comes to the conclusion that it is imperative to improve China's disaster emergency legal system. Through the legislation construction, system and organ building, the construction of disaster emergency legal system in our country can be much more improved.The writer hopes to make some contributions to the researches on the constructions of China's disaster emergency legal system from all the careful studies, especially though the "Wenchuan Earthquake".
