The Development Of The Legal System For Protecting The Cultural Heritage In Xuhui District, Shanghai Since The Reform And Opening-up Policy

Chinese society has developed and the history has made great progress in the past thirty years of the Reform and Opening-up Policy. During the period, human beings have paid more and more attention to cultural heritage. People are no longer strange to it. The protection of heritage also begins to enter their daily life. Why do we protect cultural heritage? What is cultural heritage? How are we supposed to protect, develop and use cultural heritage? We are constantly considering these problems. In fact, the protection of cultural heritage is not only for its beautiful and artistic taste that can be appreciated, researched and used for travel. What's more important, it retains the outstanding traditional culture to inherit and develop the essence of culture of the Chinese nation. Modern cities are engulfing the traditional feature of the historic ones step by step. Distinctive streets, houses and residential communities are replaced by the buildings and housing estate of the same pattern. Some cities of local characteristics have lost the personality and charm that should be combined by history and culture. The development of cities is beyond reproach. We don't want to go back to old times. However, we have made mistakes because we damaged and removed cultural heritage. We don't know the value of those precious cultural relics because we lack the necessary accomplishment of history and culture. Therefore, a lot of cultural heritage disappear under the tide of"great development", never recycled. Xuhui District is a cultural region in Shanghai, having splendid cultural heritage. The protection of cultural heritage is always leading in Shanghai and in China. With economy developing highly and material civilization making continuous progress in Xuhui, the People's Government of Xuhui District is always dedicated to protecting cultural heritage in the field of law, institutions, ideological understanding and administrative measures. It provides the comprehensive development of regional economy and society with the soft power of culture, promoting the virtuous cycle between them and increasing the urban competitiveness of Xuhui. However, as far as the legal system is concerned, the legislation for the protection of cultural heritage in China is not systematic or perfect. It has not formed the comprehensive security system of law. Therefore, Xuhui District has to explore and seek the pattern of the protection of cultural heritage which fits itself, guided by the spirit of law and the administration in accordance with law. So, I research and discuss the development of the legal system for cultural heritage by taking Xuhui District as a view, which has realistic significance in theory and practice. There are a total of five chapters in this paper. The first chapter explains the significance of the issue as well as the background and purpose of the research. Then, I lead to the concept of cultural heritage, the content, methods and measures of protection. I also introduce research ideas and methods of this paper. The following four chapters describe the overview of the construction of the legal system for cultural heritage in Xuhui District since the Reform and Opening-up Policy, focusing on its satisfactory results and bottleneck problems. Then, I quote cases to analyze and summarize outstanding problems and measures that respond to them when the law of the protection of cultural heritage in China is put into practice in Xuhui District. Then, I summarize the part of the legislation for the protection of cultural heritage in foreign countries that we can learn from and introduce by citing the advanced experience of the legal system for the protection of cultural heritage in Japan, France and the United States. In the end, I summarize the methods and channels that we can use to promote the construction of the legal system for the protection of cultural heritage in Xuhui District. I also make some suggestions on the legal system. I hope that my theoretical results will make more scholars study the legal protection of cultural heritage to further promote the construction of the legal system for the protection of cultural heritage in China.
