Analysis Of The Legal Problems In The Coordination Of Beijing-Tianjin-Hebei Transportation Planning

Transportation planning is an important guarantee for the smooth progress of transportation construction.Beijing-Tianjin-Hebei transportation integration is a national strategy.Analyzing and solving the legal problems in its planning coordination is conducive to providing theoretical support for Beijing-Tianjin-Hebei traffic integration construction at the legal level,thus making the Beijing-Tianjin-Hebei traffic integration strategy greater in practice and promoting the coordinated development of the Beijing-Tianjin-Hebei region.Firstly,this paper uses the method of theoretical analysis to define the basic concepts of Beijing-Tianjin-Hebei transportation integration planning coordination:regional transportation integration;regional transportation integration planning coordination;and based on the actual development of Beijing-Tianjin-Hebei traffic planning,analyze the influence of Xiong'an new area and Tongzhou Sub-center Transportation Planning on the coordination of Beijing-Tianjin-Hebei transportation planning.Propose the legal issues faced in the Beijing-Tianjin-Hebei transportation integration planning.Secondly,through the analyzing of the national level planning legal system and the existing planning legal system of Beijing-Tianjin-Hebei,combined with the practice analysis,that in the existing transportation planning legal practice in the Beijing-Tianjin-Hebei region there are some problems should be proposed:lack of effective guiding principles for regional transportation planning legislation,lack of unified transportation planning coordination legislative organization regulations,the legislative mechanism of the transportation planning coordination procedure are not sound enough,and the legal provisions of the regional transportation planning supervision mechanism are lacking.Thirdly,it analyzes the legislation and practice of transportation integration planning in five major regions including the Pearl River Delta region,the Yangtze River Delta region,the Tokyo metropolitan area,the New York metropolitan area,and the London metropolitan area.By combining that with the current situation of the transportation integration planning in the Beijing-Tianjin-Hebei region,it summed up the feasibility of the experience for reference.Finally,it puts forward measures to improve the coordinated legal system of transportation planning in Beijing-Tianjin-Hebei integration.First,we must improve the construction of the Beijing-Tianj in-Hebei transportation planning legislative system,including the national level,the Beijing-Tianj in-Hebei region,the Xiong'an new district,and the Tongzhou sub-center legal system.Second,clarify the basic principles of regional transportation planning coordination,including promoting the rational flow of population and resources,focusing on sustainable development,adhering to the people-oriented and improving the integrated transportation system.Third,legislate to establish a unified regional transportation planning organization,to establish a comprehensive and hierarchical regional transportation planning agency,whose rights and obligations of should be clarified at the legal level.Thus,the occurrence of absenteeism can be avoided.Fourth,we must improve the regional transportation planning procedures,including investigate the traffic requirements before planning,legal procedures of making planning and transportation planning evaluation mechanism;Fifth,improve the supervision mechanism for regional transportation planning implementation,including internal supervision mechanism of transportation planning,comprehensive supervision mechanism of relevant departments,and integration into social supervision mechanism.
