"Housing" is a worldwide, long-lasting topic. All countries are committed to the building of housing security-related system. China’s affordable housing system is mainly composed by the economic affordable housing, low-rent housing, public rental housing. It is an important part in the housing security system. Affordable housing, low-rent housing has played an important role in solving the housing problems of the city, however, over time, the "sandwich class" housing problem has become increasingly prominent, so the public rental housing have emerged. In the management process of affordable housing and low-rent housing, the problem of "difficulty in exit" is clear. The Public rental housing’s "Exit" problem will also become an important issue that needs to be resolved in the building of public rental housing system. Since public rental housing was born late and there is lack of specific study by theorists on the withdrawal system of public rental housing, the research on the legal issues of "exit" problem in public rental housing has important practical and theoretical significance. In this thesis, we take the legal system for the public rental housing exit as the object and gave an outline of the basic conditions of the legal system. Also, made an analysis of the problems in the exit, and on the basis of experience drawn from extra-regional countries and regions, some recommendations were brought up to improve our legal system for public rental housing exit.The first part is an introduction on the research background, significance, methods and status at home and abroad of the legal system for the public rental housing exit.The second part studied on the basic issues of public rental housing by the method of literature analysis, paving a theoretical way for later research. It emphatically analyzed the meaning, nature and characteristics of public rental housing. Especially by use of the knowledge of jurisprudence, it made a profound analysis on the importance of including the public rental housing exit in the legal regulation. Also summed up the reasons resulted in the subject matter of public rental housing exit.The third part made a summarized introduction on the current situation of the legal system for public rental housing exit. Meanwhile, by using document analysis, relatively draw method, theory with practice method, it made analysis on the problems exist in public rental housing exit. It pointed out that unreasonable access conditions, incomplete legal system and unsound supporting system in the legal system for public rental housing exit are the prominent issues influencing the our work progress.In the fourth part, by the method of Comparative analysis and from the angles of public housing occupants structure control, access conditions, exit conditions, incentives and punitive measures, it made study on the legal system for extraterritorial typical country or territory’s public housing exit, thus provided a good show of advanced experience, and reference for the exit system building of the public rental housing in China.Through an analysis on the problems in our country’s exit system for public rental housing and a comparative analysis of extraterritorial’ system, we have come to a profound understanding. The law is an important guarantee for the normal carry-out of public rental housing exit system. Only by increasing the punishment as well as establishing incentives, we can make efficient operation of public rental housing work. Specialized public rental housing management department can better manage the work of the public rental housing exit work. Complete guarantee measures can reduce the exit resistance after the exit of the public rental housing. Therefore, in Part five in the design of improving the legal system for public rental housing exit, it focused on the description of building the legal system for public rental housing exit, which attaches great importance to the use of rewards and punishments binding mechanism in the specific content of the Legal Construction. In addition, in the building of security system after exiting, it made innovative suggestions of mandatory purchase fund accumulation and establishing affordable housing Committee at all levels.
