Study Of Legal Correction Mechanism On Proift Distribution Of State-owned Enterprises

State-owned economy plays a leading role in socialist market economy of our country and thestate-owned enterprises in China also give even more weight in our economic society. The reformof state-owned enterprises is always the bone of contention in the financial field.Since the reform and opening up, along with the favorable transformation of our marketeconomy environment, a lot of state-owned enterprises had a improving on the operating conditions,some of them even rank among the top500. However, the profit distribution of state-ownedenterprises is always the bone of contention in the financial field. Although the law "The centralenterprise state-owned capital gains for the provisional measures" has made regulations on theproportion of central enterprises turned over to the profits among different industry and differentcategories, it has not been resolved properly up till now. With the gradually enlarged gap betweenrich and the poor, the news about high social welfare benefits, high-income of state-ownedenterprise has revealed, Profit distribution of state-owned enterprises become the focal pointagain.A large number of profits of the state-owned enterprises have been self-digested,which lead tothe loss of state-owned capital,expand of the gap between rich and poor and other socialproblems.While the justice of social are breached,the establishment of a harmonious society ishindered.This paper puts forward my own views to the necessity of state-owned enterprise profitdistribution and correction mechanism by tracing back to the history of the state-owned enterpriseprofit distribution system,practical analyzing on related practical issues of abroad,and making areference to domestic academic research.The article is composed of four parts expect introduction and epilogue.The first chapter introduces the history of profit distribution of state-owned enterprise, tryingto give an entire realization of the tendency of state-owned enterprise profit distribution.The second is mainly about the list of law system on state-owned enterprise profit distributionin several developed countries,and on this basis,making an analysis of its own advantages,in orderto find advanced experience which goes with the practical circumstances in our country.The third part introduces the current situation in our country, including excessive funding gapof social security, the huge disparities in wealth. Then put forward the necessity of legal correctionto regularize the profit distribution of state-owned enterprise. Combined with the central issueconcerned by the theoretical circle, summarize the hard part of the correction on profit distribution,in order to solve them in the following part.The fourth part is the conclusion of this paper. Firstly, establish a set of mechanisms withclearly defined responsibility, divided the responsibilities of the ministry of finance, the state-ownedassets supervision and administration commission, and the state-owned enterprise in the profitdistribution correction mechanism of state-owned enterprises.
