The Study Of Subject Setting Of Community Correction

Community correction, relative to imprisonment is another pattern of punishment. This patternincludes putting criminals whose crimes are not heavy and are not badly harmful into an openenvironment like community, so the government and the social institutions could clarify their acts.The most different feature of this pattern, contrary to the imprisonment, is that the subjectapartments that will operate the whole process are the special non-benefit institutions along withthe government. Such difference is not only the feature of this pattern but also the necessaryprecondition of the operation. From a multi-culture perspective, the community correction is aproduct of both the duality of human society and the diversification of public administration. Theseparation of the political state and civil society making civil society to rise, and the non-benefitinstitutions founded from citizens begin to enter into the area of punishment which previouslymonopolized by the government, however, the double failure of the government and the marketsystem make people turn their eyes on the community correction system. Community correction isan important content of China's current execution system reform and it is also an importantmanifestation of the management system in our society.This article includes five parts.In the preface, it begins from a topic about the reformation of public ministration on a speechpremier Wen given on a conference focused on people's lives. Then it mentions communitycorrection is an important part of ongoing punishment reform, and introduced the developing ofthis system in China and all over the world.The first part is the general introduction. This chapter first introduces the different definitionsand explanations about the community correction in foreign countries and China. By analyzing theexplanations, I think the most important and imminent issue is the diversification of the subjectmodel. Finally in this chapter, by digging into the academic foundation of the communitycorrection, I will get the conclusion that the diversification on the subject model is not only thefeature but also the prerequisite of the whole system.The second part concerns the problems and deficiencies of our current community correctionsystem. From the analyzing of the subject model setting of the four provinces that operated thesystem maturely, this chapter try to conclude that there are now some problems on the setting ofsubject model.The third part focuses on how to establish and perfect the current subject model of communitycorrection. This chapter will first introduce the experiences of experienced country that operatedthe correction system, and then make some advices directly answering the questions rising in thesecond part about the setting of the subject model of current system and further give the adviceshow to perfect the current system.The final chapter of this articleconcludes the community correction system with lookingforward to the future development.
