At present, in many primary and secondary schools, students'right of participating in teacher evaluation is considered an important thing, however, teachers'teaching and students'evaluation of teaching right in the implementation process conflict problem is more outstanding, it lack of specific in-depth research to make them coordinate. Based on compulsory education phase teachers'teaching and students'evaluation of teaching right power for research object, the literature research as the main research method, from the perspective of jurisprudence on its studied in the paper.The paper has other than the introduction is divided into four parts:The first part:Doing conceptual and scope of definition to teachers' teaching and students'evaluation of teaching right.The second part:It discusses the conflict performance in detail of teachers teach students'evaluation of teaching right and the right of the correlation in primary and secondary school. It consist of:against the autonomy of teachers, against the right to a fair evalution of teachers, against the disciplinary authority of teachers, restrict the right of students to freedom of expression, ignore students'right of participating in teacher evaluation.The third part:It discusses the causes of conflict between the two made a detailed study. It consist of:Imperfect legal system of education, weak concept of right for students and teachers, dislocation and offside for the right of school management, the lack of the right to relief mechanism, Improper Implementation of procedures for students'right of participating in teacher evaluation.The fourth part:It puts forward coordinated measures for primary and secondary school teachers teach students'evaluation of teaching right and the right of conflict:perfect sex of laws and regulations, sets up the rights of equality between teachers and students, view of accurate positioning school power and perfect rights relief mechanism and optimization program design.This paper, the main findings of teaching is to build up the right of legal status, refined, teachers and students in teaching and teaching assessment on the right and obligation, perfecting the right relief mechanism is teaching right and the right of teachers'teaching of harmonious development of the best path selection.
