Land is the most basic production material in agricultural development, and is also the most basic life security of farmers. Transference of rural land is an effective means to achieve a reasonable allocation and efficient utilization of the rural land, and this is also the only road to promote the socialist new rural construction and develop modern agriculture in China.At present, with the deepening and the quickening of the transference of rural land, there exist various forms and means in the transference of rural land circulation in our country. However, due to certain problems in the rural land system, the government and the farmers, the damage of farmers' rights has become more and more serious in the process of land transference, which is manifested as follows:the obscure rural land property violates the interests of farmers; the transferring operation is not standardized; the government and the farmer have disagreements on benefits; the standard of land transferring rent proves to be unreasonable, and compensation levels presents to be rather low. Since such problems appear as the lack of guarantee of farmers' interests in rural land transferring process, and the difficult employment for farmers who lose their croplands, the people coming from different localities to appeal to the central authorities for help, as well as the conflicts between the government and the farmers are increasing in both number and seriousness. During this process, the protection of farmers' rights and interests involved is not only an important economic issue, but also a serious political one, and this becomes the main factor of influencing the construction of a harmonious rural society. The tension has become a major danger which will undermine social stability, and influence the construction of harmonious socialist society.The basic problem of rural development lies in the rural land transference in the new situation. It is imperative to ensure an ordered transference of rural land, to protect farmland, to solve the problems of landless farmers, and to protect the fanners' rights.This article analyzes the combination of the transference of rural land and the protection of farmers'rights and interests protection, expounds the protection of fanners'rights in the process of land transference from the angle of public policy, and highlights the importance of public policy in solving problems occurred in the land transferring process. Chapter One is a brief introduction of the present study, including research background, significance of the study and the definition of relative concepts. Chapter Two is literature review of the theory adopted. Chapter Three analyzes farmers' rights protection policies in the process of rural land transference. Chapter Four lists the problems existing in the protection of farmers'interests in land transferring process, together with a cause analysis; Chapter Five is devoted to make suggestions on how to perfect the protection of farmers' interests, in terms of farmland property rights,the role of government, intermediary service organizations, and so on.
