Study On The Protection Of Farmers' Rights In Rural Land Transference

Agriculture is the foundation of the national economy,the most basic means of production of agricultural development is land,and the basic livelihood of farmers is the protection of land.Land transfer in rural areas is an important means of land rational allocation and effective use.With the deepening and speeding of land circulation,more and more contradictions occur during this process,and the problems of damage to the interests of farmers emerge one after another.At present,land transference in Lai village is performs in a variety of forms and ways,but because of the irregular land system,the dislocation of the government and autonomous organization,farmers' lack of legal knowledge and self-protection consciousness,in the process of land transfer farmers suffered damage.Based on the questionnaire survey and in-depth interviews,this paper analyzes the farmers' rights and interests in the land circulation,which are shown in the unreasonable rent standard,low level of compensation,farmers' low economic returns in land circulation,the right to know and independent choice not be guaranteed in land circulation,protection of famers' basic life not in place after land transference,and the absence of government.These problems are related to the survival of farmers,poor management will inevitably lead to the contradiction between farmers and village collective organizations,seriously can even lead to the conflicts between farmers and local government,which will affect the development of Lai Village,count against the harmony of Lai Village,and go against the construction of new rural areas.To create a stable environment,stability is very important,and stability will bring the vigorous development.Therefore,the legal and orderly circulation of land,the protection of cultivated land,and the protection of the legitimate rights and interests of farmers in the process of land transfer in Lai Village is particularly important.In this paper,two aspects of Lai Village land transfer in violation of the interests of farmers are studied:First,the performance of the rights and interests of farmers which have been infringed,and the second is how to protect the rights and interests of farmers against infringement.In the past 20 years,the land circulation in Lai Village has gradually damaged the rights and interests of farmers.With the improvement of farmers' democratic consciousness and self-protection consciousness,these illegal acts must be reversed,so as to truly protect the rights of farmers as the main body of land transfer,so that the legal transfer of land on the track of order.In order to carry out land circulation in an orderly manner and protect the legitimate rights and interests of peasants,we should find out the government's position and standardize the administrative power of the government and make the farmers become the main body of land ownership.We must perfect the relevant procedures of land acquisition and market operation,to enjoy the value of land rent and land value-added;to build an effective land management system and to establish a market-oriented system of land transfer throughout the region;to improve the quality of farmers,the establishment of farmers' own rights organizations.
