The right to adequate housing is a fundamental human right, and it is an obligatory responsibility to achieve citizens' fundamental human rights. Because of the long-term deficiency of government functions, the construction of the housing security system in our country is far behind the level of the society development. A great quantity low- income groups in our country is excluded by housing markets supported by high housing prices and limited indemnificatory housing supply. These people are in urgent need of solving the housing difficulty by the housing security system. In recent years, the public rental housing, as the important part of the indemnificatory housing system, is rising as a type of indemnificatory housing, and it puts forth effort to resolve some people's housing difficulty, which includes lower-middle-income families in cities and towns, "sandwich layer", new employment and migrant workers. As public rental housing which includes wide coverage, the open operation mechanism and flexible subsidy standard has eliminated the domiciliary register barrier of the housing security system in our country, is important amendments and innovations for the housing security system in our country.At the present stage, educational circles' research for public rental housing mainly focuses on Economics, sociology, Public Policy and so on, so as to rarely systematically analyze and dissertate it from jurisprudence angle. Therefore, this article choose Chongqing Municipality which the scale of construction of the public rental housing is largest and system design is most perfect for carding and researching the legal system of the public rental housing in our country.The thesis amounts to thirty-six thousand words, and divides into four parts:PartyⅠThe fundamental theory of the public housing. First, expound the concept and nature of the public rental housing and define range of study of this thesis; second, analyze the background of the beginning of the public rental housing and dissertate the intrinsic association between the emergence of the public rental housing and the reform of housing system from deep depth; third, clear the position of the public rental housing in the system of the housing security in our country through comparing the predominance of the public rental housing system with the predominance cheap rental housing system and affordable housing; last, analyze the legal principle base of the public rental housing, including theory of the fundamental human right state intervention, and provide the theory basis for discussing the legal system of the public rental housing during the next article. PartyⅡThe general situation of the public rental housing system in Chongqing Municipality. First, expound the present situation of the development of the public rental housing in Chongqing Municipality and specially analyze the innovative meaning of "Chongqing Model"; second, systematically expound the fundamental content of the public rental housing in Chongqing Municipality. On this basis, analyze the problem of the system design, for instance, lack of legal safeguard, access system and distribution system is not perfect, subsidies set is not reasonable, exit mechanism is not perfect, the channel of financing is narrow, and so on.PartyⅢThe experience and reference from the housing security system of another area. Base on the condition of our country, and target to generalize and summarize the common ground of the public rental housing system from every country (district), so as to gain experience and inspiration for improving and perfecting the legal system of the public rental housing in our country.PartyⅣConsummate legal system of the public rental housing in our country. This thesis focuses on researching the perfection of legislation for the perfection of the legal system of the public rental housing. Make effort to solve the problem of the legal system of the public rental housing in our country by constructing the following legal frame system: First, promulgate <Basic Housing Security Law>, and clear and definite the civic right to adequate housing, strengthen government function, and establish the important position of the public rental housing in the system of the housing security in our country; second, under the frame of <Basic Housing Security Law>, refer to the success experience of the foreign housing security system, combine with the problem of the public rental housing in Chongqing Municipality, and then, lay down <the rental public housing administer regulations>, make a across-the-board rule to the basic principle of the public rental housing system, regulatory authority, basic coverage, manners, standards, the raising of the source of houses, the rental setting mechanism, the access mechanism, the assignment mechanism, the exit mechanism, the legal responsibility and so on. On that basis, consummate the related systems, including the individual credit system and the housing finance system, so as to break through the public rental housing supervision and the straits of financing.
