Currently, academic misconduct is serious and it disrupts the normal academic order. Scholars discuss academic misconduct, a matter of opinion. But it is less to study academic misconduct from the viewpoint of Institution. The paper uses literature research method, interdisciplinary research method, case analysis method to study academic misconduct from the viewpoint of New Institutional Economics. The purpose is to through the analysis of academic misconduct, lead to further academia and social concerns, curb the occurrence of academic misconduct, pure academic atmosphere, and promote the healthy development of Chinese academic.Firstly, the paper discusses the status of academic misconduct, the nature of academic misconduct, and criteria. Secondly, the criteria used to judge"corrective"and"misconduct"for multiple contributions and fabrications tampering. Finally, papers use of cost-benefit theory ofNewInstitutional Economics,for multiple contributions and fabrications tampering as case, to discuss the causes and countermeasures of academic misconduct.The paper has three innovations: First, the nature of academic misconduct. It through exaggerate and distort the academic achievement to fraud the recognition of academic community. Second, four criteria of academic misconduct: subjective intent, fraudulence, against the moral and standards in academic, infringement of intellectual rights. Third, papers study on academic misconduct from the viewpoint of New Institutional Economics. It is new viewpoint. It requires a strong capacity of theoretical analysis to discuss the academic misconduct, using New Institutional Economics. Because author's capacity is limited, it needs to be improved.In summary, the paper study academic misconduct from the viewpoint of New Institutional Economics, rich in content and significant innovations, reaching the purpose of the study, has theoretical significance.
