Analysis And Research On Patent Quality Of Our Country Enterprise

The total amount of patent applications in China has achieved 7 million at the end of 2010. China has formally entered the list of world patent powers, however, most of the patents are utility models and design patents, analyzing from the statistics, the amount of invention patents only take up 18% of the total authorized amount, the quality of patents situation causes people's concern. In the meantime, the patent filings in major developed countries dropped significantly, various countries begin to control the quality of patents by improving the standards of patent licensing.As the main strength of innovation, enterprises'amount has accounted for 60% of the total patent applications. Under the circumstances of increasing awareness of intellectual property rights, the total amount of patent application of China's enterprises increases dramatically, however, the patent application structure is irrational, moreover, the low rate of patent licensing, etc., causing low quality of the enterprises'patents. This paper makes an analysis to the current situation of enterprises'patent quality in our country, gives a preliminary definition of patent quality by summarizing research status at home and abroad, and summarizes the evaluation indicators of patent quality in order to build a comprehensive patent evaluation system for our enterprises. Meanwhile, this paper adopts patent quality evaluation system to analyze the current enterprises'patent status, and the analysis found that the structure of patent application is irrational, the patent maintenance ratio is too low, the utilization of patent is not high, and the amount of PCT patent application is too small. Analyzing the causes of the low quality patents based on the current situation of our enterprises, the main reasons exist in the following aspects: less government financial investment, low standards of patent examination, weak patent awareness, as well as the poor third-party patent service. On account of the current patent quality status in our country, this paper proposes the following measures: increase government and business innovation, establish and perfect laws and regulations as well as the patent examination system, enhance patent awareness, improve patent management system, accelerate the development of patent agencies and the education of patent service personnel and so on. Thereby, promoting China's innovation ability and improving market competitiveness, in order to promote China into an innovative country as soon as possible.
