Research On Current Situation And Evaluation Measures Of Chinese Patent Quality

Since patent system was carried out and taken into effect in China in 1985, the total number of patent application has reached more than 400million till 2007; however, we should pay attention to disadvantages of big number of patent application, low patent quality, and lack of capacity of innovation. Meanwhile developed countries have being taken measures to evaluate patent quality and quicken steps to regulate their patent structure, which gives enlightenment to Chinese patent system.This thesis, firstly analyzes realistic necessity of patent quality research and patent quality promotion. Secondly the thesis tries to give a comparatively specific definition of patent quality from the aspects of origin of vocabulary and evaluation measures of patent quality .Thirdly the thesis analyzes current situation of Chinese patent quality and draws a conclusion: Chinese patent quality is comparatively lower than that of developed countries for the following reasons: irrational patent structure, low proportion of invention patent in the total number of patent application, small amount of granted patent and granted invention patent, short lifetime of granted patent and low proportion of patent practice, which is on account of the following effect factors: deficiency of Chinese patent policy, deficiency of government financial support, deficiency of relative patent law and rules and lack of consciousness of patent strategy for enterprises. Therefore the evaluation measures should focus on improvement of Chinese patent policy, Chinese paten law and rules, government financial support increase on patent strategy and Chinese enterprises patent strategy consciousness enhancement. Only when the above and more measures are taken, can evaluation of Chinese patent quality be reached and the aim of Chinese Intellectual Property and Construction of Independent Innovation Countries be fulfilled.
