Conpensation On Land Expropriation In Underdeveloped Area

Land requisition mainly refers to countries change the rural collective land to state-owned land and gives compensation to the executive acts for the needs of public interest.In a lot of practice of agricultural land requisition, the interests of farmers are damaged frequently. The undeveloped regions have stronger desire to accelerate economic development and more rapid action, due to the objective social gap of regional economy. However, in the existing land requisition system and basic economic conditions, the government in undeveloped regions usually provide land resources as a concession to improve the investment environment in order to reduce the economic construction and land requisition cost and enhance the attraction of external funding, which victimizes the interests of the farmers objectively. As all the landless farmers across the country, the farmers in the undeveloped regions are facing many difficulties in life, employment, medical care and so on, and the difficulty degree is even more serious. China's compensation standard for land requisition is low, which caused a lot of social conflicts and land disputes. This thesis begins from the main characteristics of farmers in undeveloped regions, the basic living conditions and difficulties of the landless farmers, according to the exposed contradictions and problems in the farmers land rights protection during the land requisition process in recent years, and studies on the existing land requisition compensation. This thesis found that there are great differences and shortcomings between the existing land requisition compensation system in China and that in some other countries through comparative analysis on the existing land requisition compensation system in China and in some other countries. Through research, I think that our existing land requisition compensation system cannot meet the development requirements of our social economy, mainly because the land requisition compensation standard is lack of scientific basis identified by the annual output value of the use of land in multiples. This thesis put forward specific policy recommendations and safeguards measure from five aspects. Finally come to the conclusion the core to solve the interest conflict of the landless farmers in the undeveloped regions is land requisition compensation system and the key point is social security and resettlement. We should start with solving system absence and government function offside and establish the settlement compensation mode which is combined with the land requisition compensation mechanism, monetary compensation, land resettlement, land shares, job placement, law aid and social security, to make the landless farmers effectively benefit from the process of urbanization, not "victims".
