China is staying the period of rapid urbanization currently, it has brought some serious contradiction between urban land development and land resource protection. In order to protect ecological environment and guarantee national food security, central government demand to protect basic farmland strictly and control the scale and quantity of construction land. On the contrary, local governments request more construction land to improve local economy. In the revision of the overall land use planning, central government dispose land use zoning regulation index designedly, which can not meet the needs of local economy development.On the basic of land development rights and land use zoning regulation theoretic, this article will find solution of allocating and transferring land development rights in land use zoning regulation. The main contents are as follows.Section 1, this part will define the meaning of land development right scientifically, summarize the transfer of land development rights in foreign countries and the ongoing research in China.Section 2, with the introduction of land use zoning system, its social objectives, main contents, related indexes, the similarities and differences between land development rights, etc. Externality theory and Government control theory are the most important theories in this article. Then we will introduce and apply land development rights theories.Section 3, as we know, there are two main indexes in the revision of the overall land use planning, the first one is basic farmland protection index, the other one is construction land index. Local government can not dispose land use zoning regulation indexes fairly and reasonably. We will take Xiangcheng, Suzhou City for example, and learn from this city for how to dealing with the problems with land development rights theory.Section 4, we will introduce the land development rights system in England, the USA, France and Taiwan particularly, it includes the advantages of land development rights application, the ascription of land development rights, the method of price calculation, the transfer program, and the Limiting factors. Then we can find the differences between China and foreign countries. We can learn from other countries, and the application of land development rights in China is feasibly.Section 5, in the land use zoning system, China dispose planning indexes with planning tools, which will impact local economy development. With the introduction of land development rights in other countries and the experience of Xiangcheng district Suzhou city , we can learn from them, establishes a land development rights transfer market, dispose land development rights with market-based instruments. Planning tools and market instruments will be combined to solve the problems in land zoning regulation. In this part we will propose professional research about land development rights distribution methods and processes.
