The Research On Intellectual Property Risk Evaluation And Prevention In Cooperative Innovation Dynamic Alliance

With the development of economic integration and the advent of the knowledge economy, the external environment that the enterprise relies for existence has undergone great changes, innovation become more and more important in the enterprise's strategies of development. But, the enterprise usually can not own all kinds of necessary resources while facing the complicated innovation. Dynamic alliance is an important innovative organization model, its main advantage relative to the traditional organizations is that it can integrate resources in different enterprises. It has great improvement for the high quality innovations to enterprises. But, many case studies fund, the probability of successful dynamic alliance is not high, and the waste is terrible once it fails. About dynamic alliance, which based on knowledge sharing and for the purpose of cooperative innovation, the key factor to its success is knowledge can flow quickly and free among partners. Because of the characteristic of dynamic alliance and knowledge, the current situation of our country's intellectual property surroundings, intellectual property risk is one of the most important risks to cooperative innovation dynamic alliance. Understanding and managing intellectual property risk rationally concerns the stability as well as the success of dynamic alliance.Firstly, this paper summarizes the relevant literature datum in or out of our country, including cooperative innovation, dynamic alliance and intellectual property. About cooperative innovation, there are its concept, motivation, mode and risk. About dynamic alliance, there are its style of setting, partner chosen, competition and cooperation relationships, risk management. About intellectual property, there are risk classification and protection. In addition, the theoretical basis to study cooperative innovation dynamic alliance and the method to study risk are mentioned as well.Secondly, this paper analyses the intellectual property risks of cooperative innovation dynamic alliance from three dimensions, namely process, source and type, based on the introduction about characteristic, type and life cycle of cooperative innovation dynamic alliance. Then it constructs a 3D analysis model of intellectual property risks in cooperative innovation dynamic alliance. Here, process dimension do analysis based on three stages to the life cycle of alliance. Source dimension do analysis from inside and outside of alliance. The main risk sources are person, organization and knowledge inside alliance, legal, economic and cultural environment outside alliance. In type dimension, intellectual property be stolen or loss innocently are dividend according the initiative of partners.Thirdly, this paper evaluates the intellectual property risks of cooperative innovation dynamic alliance. It designs a series of indexes according to fuzzy synthetic evaluation based on set-valued statistics, then establishes an intellectual property risk assessment system; gives different comprehensive assessment value appropriate warning value, then builds up an intellectual property risk warning system. At last, the practical application shows the feasibility and maneuverability of the above evaluation method. In the case, the main intellectual property risk is from inside, and should be focused on.Finally, this paper brings forward the corresponding prevention method for different intellectual property risks of cooperative innovation dynamic alliance, then establishes an intellectual property risk-prevention system which including endogenous system and exogenous system. Endogenous system is designed from two aspects, establish risk management institution and clear its duties. While about exogenous system, legal system and social system are included.Dynamic alliance is one of the most important model of cooperative innovation. Enterprise must realize the existence of intellectual property risks while take part in dynamic alliance for taking flexibility of competition and profits of innovation. Then build an assessment system and a prevention system about intellectual property risks, set up and improve the system for intellectual property risk management.
