As an age-old country, China has about5000years history, and there are manyvaluable intangible cultural heritages as traditional opera, shadowgraph, paper-cut,dance, sings, myth, traditional production skills and folk-customs on this timehonoredland. These heritages are heterogeneous of their styles, colorful of their content, andunusual in the world. These heritages are created by every nationalities in China. Theseheritages are not only the treasure of China, but also the treasure of the whole world.Tujia nationality is a inland group that lives in Hunan, Hubei, Guizhou, andChongqing provinces in China. Thousands of years, the people of Tujia createdprosperous civilization, and they leave so many valuable cultural heritages. But with thedevelopment of modernization and industry in China, the protection and inherit ofTujia’s intangible cultural heritages are not a easy thing. How to advance the legalprotection of Tujia’s intangible cultural heritages in Enshi by improving somecorrelative laws is becoming a very important problem at present. So this article baseson this problem, and discusses the mechanisms and the functions of the the protection ofTujia’s intangible cultural heritages in Enshi.The article has four chapters. The first chapter is about the history of the protectionof the intangible cultural heritages. The signification, the characters and the origin of theintangible cultural heritage will be introduced in this chapter. The second chapter isabout the legal protection of the intangible cultural heritage. It includes the actuality, thetheoretic bases and some abroad experiences of the legal protection. The third chapter isabout the actuality of the legal protection in detail. The achievements of the legalprotection will be shown, and some important problem of the legal protection will beanalyzed. The forth chapter is about how to improve the manners of the legal protection,and the analysis bases on the principle of the legal protection, the function of the legalprotection, the legislation and the judicature. This chapter will comprehensive discusshow to protect the intangible cultural heritages in Enshi by law.
