At present, China’s tourism industry has developed rapidly and become a forcefor economic development. And a part of people’s lives. However, there are a lot ofproblems in the process, the focus is the issue about the traveling consumers’ rightsand interests legal protection. For this problem, main point of the paper is strengthensupervision&administration of government.The paper is constituted by five chapters, the first chapters describes thebackground of the thesis and domestic present research situation of tourism, thepaper’s construct and main content, research significance and innovation. In thesecond part, through summarizing the content of the protection of the rights andinterests of tourism consumers, the author analyzes the elementary theory of theprotection of tourist rights and interest, such as the concept of tourism and travelingconsumption. And then the author explains the concept of tourism rights and interests,and sets out five main rights and combined classical factual cases. The third chapter:tourism consumers’ right protection in comparative study. According to thecomparison of protection legislation of tourism consumer in U.S.A, Japan andThailand, from which we can learn the feasible legal experiences as a reference.Chapter four deals with the tourism consumer rights and interests protection systemand makes a series of suggestions. In practical terms, firstly, the traveling legislative pacesshould be accelerated and the traveling contract should be named. Secondly,the admittancesystem of travel agency should be strictly established, the quality guarantee of travel agency has tobe strictly supervised, strictly supervision and administration of the traveling contract system andthe tutor guide have to be established, and the unfair competition on the travel agency should beregulated. Thirdly,we should establish a reasonable travel service and compensation system andsupport the compensation of spirit damage. At last, we should create a good environment todevelop the tourism Industry Association and the Consumers’ Association, which we shouldcombine together in order to achieve a good social effect. In the last chapter, the authorsummarizes the full text and carries on a comprehensive and systematic summary forthis paper.
