The Research Of Social Rights Safeguard For Chinese Migrant Workers In The Process Of Urbanization

Since the reform and opening up, with the change of economic system, moreand more farmers have left the land, selected a city as another home. Because of theconstraints of the urban and rural social system ingrained, so the famers becamespecial groups with dual role in China—migrant workers. With this special groupbecoming bigger and bigger, the urban landscape is changed significantly and theeconomy and society develop rapidly, but their harvest is: meager income, simpleliving conditions, injustice educational opportunities, difficult to promotion, the lackof social safeguard. As time pass by, their internal social structure has changed—thenew generation of migrant workers is to gradually replace their parents. According tothe survey, the current generation of migrant workers account for about nearly60%,most of them were born in1980’s, which of them have received education to someextend and which of them have lived in the city with his parents from childhood, sothey look forward to adapt to city life and become a veritable city residents morethan their parents, but now they can’t equally enjoy the same survival anddevelopment social rights as city residents. Although in recent years, the CPCCentral Committee and State Council set a number of legal policies to safeguard thesocial rights for migrant workers, but because of the subjective and objective reasonsin reality, our country can’t protect migrant workers social rights effectively frominfringement. The research on social rights safeguard of migrant workers is of greatpractical significance in the context of advancing urbanization, and building asociety harmonious society. For one thing, it can promote migrant workers to beintegrated into city life quickly, translated into urban residents as soon as possible,thereby promoting the further development of the urbanization process; For anotherthing, it is vital important to maintain the society justice, to ensure economy andsociety healthy, and to build a socialist harmonious society.This paper is base on the social reality, the use of documentary research method,interdisciplinary research method, inductive and deductive method, combine theorywith practice, history and logic methods, analysis the social rights safeguard forChinese migrant workers in the process of urbanization. This paper mainly involvesthe following three parts: the first part, promote an important role in the urbanizationof migrant workers in the new era, and thus pave the way to review the evolution ofthe CPC Central Committee and State Council on the protection of migrant workerssocial rights-related policies and made results. The second part, combined with thecurrent social practice analysis the current situation of migrant workers’ social rights,and further analysis the reasons for the damage of social rights of migrant workersfrom the objective and subjective point of view; The third part, according to thesecond part, put forward the countermeasures and suggestions on protecting thesocial rights of migrant workers.
