As an important part of the housing security system, public rental housing is a term referto that whose policy and financial support is offered by government, dwelling unit and rentstandard limited, mainly rented to median income groups at a favorable rental level lowerthan the market price. Domestic and international experience shows that, it is an obligatoryresponsibility for national to realize ’’Shelter For All ’’. To achieve this goal smoothly, thecrucial step is to establish a sound legal system of housing security. Our country has not yetbuild it perfectly because of various restrictions of historical circumstances and economicenvironment, the corresponding legal system is diseased, and the legal level is relatively low,which lead a series of problem on the quickly developing the public rental housing. Forexample, the land shortage of public rental housing, the construction fund and the availablehousing is insufficient, the exit mechanism is inadequate, and the legal responsibility isindeterminate, etc.This paper firstly elaborates the connotation, development course of public rental housingsystem. Then, it analyses and deliberates main problems in an economic law point, wishingfor benefiting the construction and improvement of the system. In this section, the paperbegins with the spontaneity and the blindness of market which will fail itself in the housingsecurity realm and make government intervention inevitable, analyses the current situation ofgovernment function vacancy and lagging legislation, proposes that it should refine thespecific legal responsibilities of all governments to ensure the legalization and norms ofeconomic mainstay in the reallocation with economic law means; improve the supply systemof reserved land, ensure the chain sustainability to solve land shortage of public rentalhousing; though combing the different public rental housing property, Put forward “limitedproperty” system; broaden the financing channels, establish a long-term supply mechanism ofconstruction and operation capital to alleviate government financial pressure; set strict enterand quit mechanism and periodic audit regimen to promote the limited resource be allocatedfairly; perfect the rental estimation system by combining government guiding price andmarket reference, execute the graded rent standard according to the income level of lessee,make rent adapt to the economic capacity of the median income groups.
