As the people’s interests spokesman, deputy to theNational People’s Congress are on behalf of duties to perform, exercising power, andshouldering the responsibility to reflect the people’s will and interests. Therefore, people’sCongress fulfilling their duties actively and giving full play to the role is the premise to ensurethe effective operation of the people’s congress.With the development of China’s political system, the system of people’s congresses havebeen further developed and the expectations of people’s Congress is getting higher and higher.But in practice, the ability to perform the duties of the deputy to the National People’sCongress and representatives of their are lack of objective conditions. As a result, there is acertain distance between the effectiveness of representative office and the expectations of thepeople. To improve the ability of representative in performing their duties, perfect theobjective conditions for them, it should strengthen the construction of the representative roleand security system, perfect the representative of executing legal guarantee, the guarantee ofthe time, so as to ensure the material and organization guarantee and so on, combined with therepresentative role and actual situation in our country, draw lessons from western countriessenator rights safeguard mechanism, in order to form the security system of National People’sCongress representatives in performing their duties to fit the needs of China’s people’scongress system and the construction, to improve the level of representative in performingtheir duties order to represent the people exercise state power better.This paper focus on improving the effectiveness of the representatives in performingtheir duties, make an argument about the problems on construction of the National People’sCongress representatives in performing their duties and security system. Mainly reflected in: first, the range of speech exempted from blameand place of liability is too narrow, the restrictive provisions of speech exempted from blameis relatively few; Second, a person vesting authority permission regulation measures are notperfect, the restriction of personal freedom prescribed imperfect, lack of relief and theprovisions of the responsibility; Third, part-time representative to represent since the time isnot enough; Fourth, the material and the imperfection of the economic conditions are stillhard problems to the National People’s Congress members to perform their duties; Fifth,service does not reach the designated position for the representatives.The fourth part, this paper puts forward some suggestions of perfecting our country’ssecurity system for the National People’s Congress members to perform their duties, aiming atthe existing problems of National People’s Congress members to perform their duties, and putforward the perfectation to cover of speech in our country’s National People’s Congress members to perform their duties, such as personal vesting rights safeguard, and on the basis ofdraw lessons from foreign experience, put forward the idea of People’s congress system offull-time and configuration and the introduction of National People’s Congress members of afull-time assistant, to ensure the representative to perform their duties smoothly.
