Study On Some Issues On Comprehensive Law Enforcement In Urban Administration

Based on the practical work of comprehensive law enforcement in urbanadministration, difficulties appearing in the process of development, the author’sworking experience of comprehensive law enforcement for many years andprominent problems found in working practice of promoting comprehensive lawenforcement in some large cities, the reasons of the existence of these issues areprofoundly analyzed in this paper. Meanwhile making wide use of theoreticalresearch results and working experiences within the field of comprehensive lawenforcement in urban administration and standing on the frontier of theoreticalresearch on national comprehensive law enforcement in urban administration industry,harmful consequences of these issues, useful solutions to them and views andopinions of the author are demonstrated; integration in the work of comprehensivelaw enforcement in urban administration in China are made concrete analysis andstudy; detailed comparison is done between large comprehensive law enforcementand small comprehensive law enforcement, especially for advantages anddisadvantages, analyzing prominent key issues of systems and natural personmanagement in current management work; and make comparison to managementmodes of western developed countries in order to find out the distance betweencomprehensive law enforcement in urban administration in China and urbanmanagement of developed countries. Many personal views are proposed and idealpattern of development of comprehensive law enforcement in urban administration inChina is put forward on the basis of advanced experience of urban management ofdeveloped countries, the current idea of administration to law in China andself-constructing direction of comprehensive law enforcement in urban administrationin this paper. It is hoped that through the study on this topic, a kind of driving effectcan be made for the further development of comprehensive law enforcement in urban administration in China. It is also aimed to find out the current drawbacks ofcomprehensive law enforcement in urban administration in China through study andresearch, and in the condition of not performing measures by the country, other legalmeans shall be used to avoid the miss points in law enforcement in actual life. Thispoints to blaze new trails in a pioneering spirit to find out other enforcementoperations for solving problems according to the accumulation of experiences inpeacetime, which makes operating mechanism of comprehensive law enforcement inurban administration further improved, mode of that more scientific and normative,administration according to law and comprehensive law enforcement in urbanadministration effectively adopted and implemented, and comprehensive lawenforcement in urban administration adapt to and meet the requirement of economicaldevelopment for modernized city as soon as possible.A large number of enforcement supervision contents and innovation measures ofcity management court are taken as examples by the author in this paper. The purposeof supervision mechanism of law enforcement is that standardize one’s own lawenforcement behavior to comprehensively put forward the healthy development ofcomprehensive law enforcement in urban administration from the angle ofself-constructing. The establishment of urban administration court is the innovationdone by law enforcement agency in practical work.，which is an administrative actthat implements specific punishment by the mode of bringing the case of lawenforcement in urban administration to court for trial. This act not only solves theissue about inequality of legal knowledge and status between clients and lawenforcement agencies, offering legal aide timely, but also works means to problemsthat clients refuse to perform their legal responsibilities after be made decisions ofadministrative punishment by law enforcement agency; implementation is hard tocarry on; law enforcement is unfair; after bringing the case to court for trial,administrative case shall be put on trial by the court in conformity with the standardof hearing judicial cases carefully, performing an tremendously driving effect forlaunching administrative law enforcement, law enforcement procedure and legalinstruments of law enforcement agency formally and strictly, and playing animportant role in the process of regulating institutionalization for the new law enforcement agency, comprehensive law enforcement in urban administration. Thelast point is the most important one. The establishment of urban administration courtgreatly inspires workers of law enforcement in urban administration in China. Theauthor also hopes that the establishment of this mode can offer a favorable referencefor solving other issues met in law enforcement in urban administration andcomprehensive law enforcement shall be well performed in China through usingpeople’s intelligence in the future.
