Studies On Administrative Violations Of Local Government Land

Today, when the land resources are increasingly scarce and urbanization is developing fast,large-scale illegal usage of land is increasingly serious with local government as the leading,which aggravated the sharp contradiction between human and the land, weakened the effect ofnational macroeconomic regulation and control policy, lead the land related department tocorruption and rent-seeking, worsen the relationship the between parties of administrativemanagement. On “land reform strict management teleconference”, Premier Wen Jiabao clearlystated “Local government should take the main responsibility for protection and rationalutilization of land". Therefore, the researches on local government land management system andregulating the local government land management behavior is significant for the protection andsustainable use of the land, the effective implementation of policies and the fast, continuous andhealthy national economy development.This paper is divided into four parts. The first part is the introduction, which mainlyintroduces the significance, purpose, content and method of the research. The second partintroduces basic theory of the illegal land administrative behavior of the local government,analyses denotation and extension of the illegal land behavior, do deep research on the constitutiverequirements of the illegal land behavior and the main theory revolved, including the governmentregulation theory, the intergovernmental relations theory, sustainable development theory, and thetheory of power restraint and balance. The third part analyses the current legislation situation andthe cases, concludes the feature and harm of illegal land administrative behavior of the localgovernment, and summarizes main internal and external reason for illegal land administrativebehavior of the local government. Based on the forward analysis, the fourth part put forward maincountermeasures to perfect the land administrative law system and regulate the local governmentland management behavior.
