| With the economic and social development,the material life is getting higher and higher,but contrary to this is that today’s food safety situation is not optimistic,since the Sanlu milk powder incident in2008,a variety of food safety issues,one after another to continue to challenge people’s bottom line,not only cause great damage to people’s lives and property,and more severely affected social harmony and stability,countries in crisis,the overall interests of public safety.The frequency of accidents of food safety on the one hand reflects the weak self-discipline of food producers and traders,but also has exposed China’s huge deficiencies in food safety regulation.Therefore,specific studies on the regulatory approach of the European Union,the United States,Japan and other developed countries,and analyze the specific circumstances of the present stage,the one idea from the author’s point of view,China’s food safety supervision.Analysis of the overall situation of the current food safety regulatory papers from the point of view of the TBT Agreement as well as administrative law,then specifc studies of the actual situation of our country,from its national conditions,and to learn from the reform experience of other developed countries,summed up China’s food safety regulation should be converted direction.In additionto the introduction and conclusion,the main part is divided into4chapters:Chapter1described the related concepts of food safety laws and regulation,and on the basis of its jurisprudence simple analysis.Chapter2according to the TBT Agreement for the perspective of a comprehensive analysis of the European Union,the United States,Japan and other developed countries,food safety monitoring system of legal and international development trends.Chapter3analyzes the shortcomings of China’s food safety laws and regulation,from the legislative point of view and the law enforcement system of defects in the food safety regulatory process.Chapter4on the recommendations of the Improvement of food safety legislation and standars,in order to put forward good policy and suggestions on China’s food safety laws and regulation. on the basis of foreign experience base and take full account of Chinas national conditions,the trinity of food safety laws and regulatory model build-led government and strive to foster social middle layer,and actively encourage public supervision. |
