The Research On The Law Monitor System Of Food Safety In China

The food safety incidents have erupted many times, which not only damaged the health of consumers, but also disrupted the normal order of market economy. Public questions and doubts test the work of food regulatory agency. food safety has become focus of governments and people around the world. Food safety issue from embryonic development to now has gone beyond the traditional areas of food hygiene. It is also the key to human existence and maintenance which the governments are facing. Therefore, the strengthening of food safety regulation is urgent. In 2009 "Food Safety Law" was finally promulgated after a difficult process. Comparing to the "Food Sanitation Law," "Food Safety Law" provides a more scientific monitoring system. Under the law the Food Safety Commission was established as the specialized food safety institute. In addition, according to the division of administrative areas, local government should establish food regulatory agencies in order to be responsible for daily food safety regulatory affairs.The thesis, which concentrates on food safety regulatory system, introduces the food safety regulation and supervisory experience in developed countries in order to enrich and deepen the food safety control theory as well as to provide suggestions for a more effective system in China. This thesis is divided into four parts the first part introduces the basic theory of food safety control, the second part analyses the legislation and practical environment of the food safety regulatory before and after the promulgation of "Food Safety Law" and focus on the highlights and defects. The third part of the study focuses on the United States and the European Union's food safety regulatory systems construction experiences and analyses advantages and disadvantages of the US and EU food safety regulatory systems.Finally, this thesis discusses the proposals for the food safety regulatory system specifically and practically. Also relevant rules and measures are introduced through the law and institution perspectives. Constructive suggestions are provided for making full use of the food safety commission and renewing the food safety standard as well as releasing the information timely openly and transparently in order to complete the food safety regulatory system.
