The rapid development of Online-banks is both opportunities and challenges for Chinese economy. Opportunities should be taken to strengthen marketing competitive forces and international competitive forces in our commercial business. Meanwhile, legal supervision systems must be set up to actively instruct and regulate it. The legal problems involved in supervision Online-banks are plenty and complex. However, legal systems for traditional bank supervision can not monitor Online-banks efficiently. How to construct legal supervision systems suitable for Chinese Online-banks becomes the core of the current stage. The development of Online-banks is different from country to country, which is closely related to this country’s economic status and qualities of people. Online-banks in China, a big developing country, where the legal basis is poor; the quality of the market is low, and economic development is behind, are quite different from those of developed countries. Though the research and exploration on legal systems supervision Online-banks in European and American developed countries becomes increasingly perfect, which can be learned when constructing our E-bank legal supervision systems, we must be aware that such reference should be grounded on Chinese own situation and practice. Only we construct E-bank legal supervision systems in line with Chinese situation, can laws regulate Online-banks.This thesis analyzes the development of our country’s Online-banks and legal regulations, and referring to foreign countries’experience, proposes the following:when constructing legal supervision systems, from a macro point of view, we should stick to the principles of combining risk-based supervision and promotion of innovation, combining justice and efficiency, protecting customers’rights and internationalism; from a micro point of view, we should perfect E-bank legal systems, build up co-supervision system, flexible market access rules, and exit mechanism, protect clients’legal rights, perfect information publication system so as to construct legal supervision system suitable for the development of our country’s Online-banks, which can efficiently regulate and discipline Online-banks, strengthen international competitive forces in our commercial business, and then promote the steady development of our country’s economy.
